Council invites the public to comment on a Planning Proposal that seeks to amend Penrith Local Environmental Plan 2010 (LEP), and a draft amendment to Penrith Development Control Plan 2014 (DCP).
LEP Review
A Planning Proposal is a request to the NSW Department of Planning and Environment to amend a Local Environmental Plan (LEP). LEPs are legal documents that guide future development through land use zones and development standards.
Council has prepared a Planning Proposal that seeks to amend Penrith LEP 2010 to correct errors, remove outdated or duplicate provisions, and improve clarity. These changes will ensure Penrith LEP 2010 remains up-to-date and fit-for-purpose.
On 23 February 2026, NSW Department of Planning, Housing and Infrastructure issued a Gateway determination that authorises Council to exercise the functions of the local plan-making authority.
DCP Review
Development Control Plans (DCPs) are documents that support Local Environmental Plans (LEPs) with more detailed planning and design guidelines. Penrith DCP 2014 applies to most properties across Penrith City.
A draft amendment to Penrith DCP 2014 has been prepared. The amendment introduces a new structure and format for the DCP, along with administrative updates and other minor changes. These updates are needed to ensure Penrith DCP 2014 remains accurate, is easy to use, and is responsive to current legislation and the community's needs.
Changes to Penrith LEP 2010
The Planning Proposal seeks to:
- correct outdated and duplicate provisions in Schedule 1 relating to Additional Permitted Uses
- update the Heritage Register in Schedule 5 relating to Environmental Heritage
- rezone land that is owned by NSW Government agencies
- fix errors and remove properties that have been acquired in Land Reservation Acquisition maps
- introduce minimum lot size controls for properties that currently do not have a minimum lot size control
- correct other minor errors, apply consistent zoning to select properties, and remove provisions that are no longer required.

Changes to Penrith DCP 2014

A new structure and format is proposed to improve readability, useability and consistency across the document. The new structure contains 5 parts, including:
- Part A Introduction: sets out the aims, principles, application and relationship with planning instruments and structure.
- Part B City Wide Controls: contains objectives and controls that apply city-wide for all development types.
- Part C Land Use Controls: contains objectives and controls to guide specific development types.
- Part D Precinct Controls: contains additional objectives and controls for development on specific sites, areas or precincts.
- Part E: Appendices: provides resources to support DCP users to prepare their development application including definitions and technical information.

A preliminary ‘health check’ of each chapter has been undertaken to ensure that references to legislation, policy, or other Government agencies are current, as well as cross-references to other chapters of the DCP are correct having regard to the new structure and format.
Duplications and outdated provisions have been removed as well as other minor corrections.
Some references to current legislation have not been updated where the changes are not administrative in nature.
Part A Introduction has been updated to expand existing savings provisions applying to the Child care centre chapter.
Chapter E16 is a key precinct chapter that applies to land known as Sydney Science Park.
The draft amendment proposes to repeal Chapter E16 in its entirety. This is because the State-led Western Sydney Aerotropolis Development Control Plan 2022- Phase 2 captures all land in the Sydney Science Park precinct, and supersedes local provisions contained in Chapter E16.
It is therefore appropriate to remove this chapter from Penrith DCP. The numbering of chapters has been adjusted to ensure it remains consecutive.
Chapter E18 is a key precinct chapter that applies to development on land known as Luddenham Road Industrial Business Park. The changes proposed to Chapter E18 include:
- amend chapter title from E18 to D16.
- insert new provisions under Section 2.9 of the chapter relating to lot yield. The new provisions seek to support the implementation of Clause 7.24 of Penrith LEP 2010, which sets a minimum number of lots within the precinct. The draft controls are consistent with a Master Plan that has been endorsed by Council at the Planning Proposal stage and will ensure appropriate distribution of the allotments across the site.
- minor amendments to fix drafting errors relating to road cross section diagrams.
- a requirement to demonstrate compliance with an estate wide cumulative noise assessment, provided as an appendix to the chapter.
Chapter C5 Waste Management is a city-wide chapter. Amendments to the chapter are proposed to provide greater clarity of existing controls and introduce contemporary information on policy and legislative changes.
Proposed amendments include:
- introduce information on the collection of Food Organics and Garden Organics (FOGO). As well as the NSW Protection of the Environment Legislation Amendment (FOGO Recycling) Act 2025, which mandates the collection of FOGO from residential development from 1 July 2030, and certain non-residential developments from 1 July 2026, 1 July 2028 and 1 July 2030 (depending on the weekly waste capacity of a development).
- clarify that single dwellings, dual occupancies, semi-detached and attached housing need to accomodate one 240L FOGO bin per dwelling, in addition to one 140L residual bin and one 240L recycling bin.
- introduce principles of circular economy, which seeks to minimise waste and encourage reuse and recycling.
- clarify controls that apply to contemporary housing types, including group homes, boarding houses, co-living housing, and manor houses.
- increase the threshold for when a communal waste storage area needs to be provided from 4 dwellings to 5 dwellings.
- update references to Council's Waste Management Guidelines (WMG). Chapter C5 is supported by Council’s WMG, which are separate to Penrith DCP and are non-statutory guidelines. Council has made updates to the WMG and consolidated the existing 5 Guidelines that apply to different development types into one single document. This is to ensure the Guidelines are user-friendly and simple to navigate.
- minor clarifying amendments.
The exhibition material has been updated to include the new Chapter E15-St Marys Town Centre that was endorsed by Council on 28 April 2025 and which came into effect on 11 February 2026.
On 28 April 2025 Council resolved to adopt an amended Chapter E15- St Marys Town Centre to support the implementation of the St Marys Town Centre Master Plan. The timing of Chapter E15 to come into effect was upon the making of the State Environmental Planning Policy Amendment (St Marys Town Centre) 2026 and associated amendments to Penrith LEP 2010. These instruments were made on 6 February 2026, with the amended Chapter E15 coming into effect shortly after.
