Amendment 24 to the Penrith Local Environmental Plan 2010 was made by the Minister for Planning and Public Spaces on 28 June 2021 and took effect 30 September 2021.

This amendment was proposed in the Planning Proposal for 39 Henry Street, Penrith. This amendment increases the maximum permissible Floor Space Ratio (FSR) for development from 5:1 to 6:1 across the two subject lots, within Key Site 7, to encourage its redevelopment with a new mixed-use development under LEP 2010 Clause 8.7 Community Infrastructure on certain key sites.

LEPs are legal documents that guide future development through land use zones and development controls. A Planning Proposal is a request to the NSW Department of Planning and Environment to amend an LEP.


At its Ordinary Council Meeting of 7 December 2020, Council endorsed the Planning Proposal, subject to the Voluntary Planning Agreement (VPA) being notified and signed. Council endorsed the VPA at the Ordinary Meeting on 22 March 2021. The VPA was notified from 15 June 2021 to 13 July 2021. These changes will be reflected in the Penrith LEP 2010 from 30 September 2021 and will be available on the NSW Legislation website. This deferred date allows the VPA to be signed and executed.

Council invited the public to comment on the proposed changes when the Planning Proposal and supporting information was publicly exhibited from 12 November 2018 to 10 December 2018.
