Council is publicly exhibiting a Planning Proposal (PP-2021-4118) for 170 Russell Street, Emu Plains (Lot 1 DP 1273251). The proponent for the Planning Proposal is Bernard Le Boursicot c/o Urbanco.

Background

The subject site is 2 hectares in size and is divided into western and eastern portions.

The western portion is governed by Penrith Local Environmental Plan 2010 (LEP 2010) and zoned E4 General Industrial. However, the eastern portion is designated as a ‘deferred matter’, which means it is not subject to the provisions in LEP 2010 and is instead subject to Interim Development Order 93 (IDO 93) and is zoned Rural 1(d) (Future Urban) zoning.

Proposed LEP Amendments

The intent of the Planning Proposal is to extend the provisions currently applied on the western portion of the site across to the eastern portion of the site, thereby providing a consistent set of planning controls.

The following changes are proposed to the eastern portion of the site:

  • Rezone to E4 General Industrial.
  • Apply a 12 metre maximum building height control.
  • Apply a minimum lot size control of 1,000 square metres.
  • Apply a Scenic and Landscape Values designation.
  • Permit Additional Permitted Uses on the site, consistent with the existing provisions under Schedule 1 Item 38 of LEP 2010 (Use of certain land at Werrington, Kingswood, Penrith, Cranebrook, Orchard Hills and Emu Plains).
  • Remove the “Deferred Matter” designation to enable the entire site to be governed by LEP 2010 instead of IDO 93.
  • Introduce Additional Local Provisions for the subject site to require development of the site to adhere with the proposed flood impact assessment and filling strategy supporting the Planning Proposal.

Draft DCP

A draft Development Control Plan (DCP) chapter has been prepared which provides detailed planning and development controls for the subject site. Proposed controls include:

  • Apply specific provisions to the subject site to protect nearby residential areas from amenity impacts.
  • Restrict driveway access to specific points.
  • Require construction of kerb and gutter.
  • Ensure that filling of the land is completed in accordance the endorsed flood impact assessment report and the endorsed filling strategy.
  • Realign the industrial precinct boundary to include the entire subject site.
  • Alignment with proposed changes to Scenic and Landscape Values under LEP 2010.

Council's decision to exhibit

At its Ordinary Meeting of 31 October 2022, Council resolved to publicly exhibit the Planning Proposal and draft DCP chapter. An Altered Gateway Determination was issued on 19 March 2024, allowing for the Planning Proposal to proceed to public exhibition.

Council is authorised to be the local plan-making authority for the Planning Proposal.
